TERMS AND CONDITIONS

1. The driver of the hired car must hold a valid and clean driving licence, and with a driving experience of 2 years and must be approved by the driver.
2. It is the responsibility of the hirer to make sure that the vehicle is parked at a secure place as he/she will be liable for any parts stolen/damaged.
3. Any hirer who is to replace any damaged parts should only do that after getting an approval from the company and in the event that it is impossible to notify the company; then the company should be notified in writing.
4. in the event that the vehicle develops a mechanical problem, the company will make all reasonable efforts to replace it with a similar one where possible.
5. In case of an accident or damage to the vehicle, other assets to the occupants or other people, the hirer should be ready to pay the excess of (10%) of the insured value, the amount is payable to the insurance company and which amount should be paid immediately or within which period is agreed in writing. 

   Accidents/Loss

   5.1 In case of accidents or damage, the lessee should inform the lessor and immediately record a statement with the police to enable the lessor forward the claim to the insurers

   5.2 If the accident cost does not exceed Kshs. 20,000, the lessee will be held responsible to cater for the repair costs.

   5.3If the repair costs exceed Kshs. 20,000 the lessor shall forward the claim to the insurers; however, the lessee shall continue to pay Kshs. 2,000 per day until the car is discharged from the garage or a lumpsum of Kshs. 70,000 whichever is higher plus any other cost not catered for by the insurers.

   5.4 The lessee is responsible to pay for the towing fees from the scene of accident to police station for inspection, then later to the Insurer's garage or point of inspection incluiding but not limited to the costs of getting police abstract.

   5.5 In case the car lost; the lessee shall immediately inform the lessor and report to the nearest police station. If the car is not found, the lessee shall continue to pay Kshs. 2000 per day until the car is found or compensated by the insure.

6. All payment terms shall be in cash or banker's cheque should the parties agree to pay via cheque. Cheques will be accepted 3 days prior to the hire to confirm clearance.
7. At the time of hire, the hirer shall pay a deposit of an amount determined by the company (depending on the vehicle) the said deposit is refundable after return of the vehicle and confirmation that its in good condition.
8. The vehicle shall be returned to the company on the specified dates unless otherwise agreed with the company.
9. The vehicle shall be operated by the hirer only and shall not be re-hired out to another person without a written clearance from the company.
10. The car shall be used for social and domestic purposes only, and cannot be used for sports, rallying or competitions.
11. If the vehicle is to be withdrawn from the hirer for services as a result of damages caused by negligent actions on part of the hirer, the company is not obliged to provide a replacement vehicle for the duration of the said service. That said the company reserves the right of hire, and is not obliged to give any reasons for withdrawing any vehicle from the hirer.
12. A fee of Ksh. 500 will be charged for every extra hour taken by the hirer above the time agreed upon for the return of the vehicle unless prior agreement with the company has taken place and an agreed upon explanation given.
13. A fee of Ksh. 500 will be charged for delivery/collection during non-working hours.
14. Early return' withdrawal of the vehicle docs not guarantee a refund of the payments made, unless a prior arrangment is made.
15. Vehicles driven off is deemed and comfirmed to have been inspected and accepted in their condition incluiding but not limited to their accessories, luxurious options and facilities.
16. The hirer is responsible to the vehicle for any damages or to the vehicle and its parts and accessories including damages to other vehicles, injury to other people or occupants including to the sire, tube and the rim of the vehicle.
17. In case of damage due to hirer's negligence, loss of use will be charged if downtime exceeds 3 days.
18. The hirer shall be liable to the cost of service, and resultant damage.
19. The hirer shall at no even assign, mortgage or plead this contract, the company. Any infraction on any of this undertaking empowers the company to demand the return of the vehicle forthwith and in the event of damage or loss of the said vehicle, the hirer shall be wholly liable.
20. All vehicle should be returned with the same measure of fuel hirer, any excess amount the company will not be liable. On the return of the vehicle, the hirer shall give the company an allowance of 24hrs on any report of director.
